GENERAL TERMS AND CONDITIONS OF SALE


General Provisions
Unless otherwise specified in special conditions contractually agreed with clients or partners, the execution of cruises and all related services – including catering and entertainment – are governed by these General Terms and Conditions of Sale, which take precedence over any purchasing conditions. Such purchasing conditions are not enforceable against “Compagnie Navi-Tour SARL”.
Any reservation or purchase of a service implies full acceptance of these General Terms and Conditions.

Reservations and Cancellations
For our gourmet cruises and themed cruises, reservations are mandatory (subject to availability) and can be made by post, online, by phone, or in person at our office in Remich.
Tickets or booking confirmations will be sent by email. If the client expressly requests postal delivery, shipping and handling costs will be charged additionally.
Unless otherwise agreed, reservations become final only after full prepayment (100%) of the booked service.
For individual customers, any reservation not honored will be charged in full unless canceled at least 72 hours in advance.
If the cancellation occurs between 72 and 24 hours before the service, a date change may be granted within a maximum period of 6 months, subject to availability and under conditions not exceeding those initially agreed.
In case of illness or death, Navi-Tour SARL accepts a refund upon presentation of a valid medical or death certificate.
Navi-Tour SARL reserves the right to resell seats corresponding to unfulfilled reservations.
For panoramic cruises and lock passages, tickets can be purchased on-site at the ticket office at the boarding point.

Reservation and Cancellation Conditions for Groups (>15 people)
For panoramic cruises, advance reservation is recommended. In case of no-show without cancellation at least 48 hours in advance, the full amount will be charged.
Unless otherwise agreed, payment must be made on the same day by credit card or cash.
For cruises with catering on board, reservations are mandatory.
For groups of more than 15 people, a special menu can be ordered upon request. A fixed menu must be selected no later than 10 days before the event; otherwise, it will be determined by the Chef.
The exact number of passengers must be confirmed no later than 7 working days before the cruise and will be invoiced accordingly.
Any increase in the number of participants is subject to approval.
The first deposit must be paid upon signing the reservation contract. The full amount must be paid at least 1 month before the cruise.
In case of illness or death, a refund will be granted upon presentation of appropriate documentation (for illness, only for the concerned person).

Cancellation Fees
In the event of cancellation (including partial cancellation), a processing fee of €15.00 per person will be charged.
Additionally, cancellation fees apply as follows:
90–60 days: 25%
59–30 days: 50%
29–15 days: 75%
14 days: 100%

Boat Rental
A 25% deposit is required upon signing the reservation contract.
75% must be paid at least 1 month before the cruise.
The remaining balance must be paid 7 days in advance or as agreed.
Attaching banners to the boats without prior approval is prohibited.
One meeting is included in the price; additional meetings will be charged.
Installation of decorations provided by the client will be charged depending on quantity.
Drink prices increase by 30% after 01:00 AM.
A surcharge of €40 per hour per chef applies if dessert service is delayed beyond midnight due to the client.

Prices, Invoicing & Payments
Navi-Tour SARL reserves the right to modify prices and information. Price increases may occur up to 20 days before the cruise or event due to rising fuel or food costs.
Deferred invoicing is subject to prior approval. Invoices must be paid upon receipt or within 31 days at the latest.
Late payments will automatically incur interest. No discounts are granted for early payment.

Cruise Regulations
Obligations of Navi-Tour SARL
The company will make every effort to ensure the proper execution of the cruise.
Navi-Tour SARL cannot be held liable for schedule or duration changes due to force majeure, flooding, authority instructions, or vessel changes.
In case of bad weather or flooding, navigation authorities decide whether the cruise can proceed. If navigation is not possible, the event will still take place unless the client is informed otherwise by email or phone.

Obligations of Passengers
Passengers must arrive at least 15 minutes before departure
Late arrivals are not entitled to refunds
All safety instructions from the crew must be strictly followed
Dangerous items are prohibited on board
No liability for theft or damage to personal belongings
Damage caused on board will be charged to the client
Proper attire is required (no sportswear, swimwear, etc.)
Access to restricted areas is prohibited

External Entertainment
External service providers are not allowed to use Navi-Tour SARL’s sound or lighting equipment.
Equipment can be rented if needed.

Insurance & Liability
Claims can only be made with a valid ticket.
Navi-Tour SARL reserves the right to cancel or modify cruises at any time for safety reasons.
The company is not liable for incidents caused by unforeseen events such as weather conditions, collisions, or similar circumstances.
No liability is accepted for loss or damage to personal belongings.

Applicable Law
French law applies.
Only the courts within the jurisdiction of the Luxembourg Court of Appeal are competent, unless otherwise decided by Navi-Tour SARL.

Pandemic and Epidemic Policy
In case of cancellations due to a pandemic or epidemic:
A voucher of equal value will be offered
or a refund minus 9% administrative fees
